Residence card refused: what to do in the first 14 days

A refusal is not the end. But you only have 14 days to appeal. We explain how not to lose time, what to write in the odwołanie and whether you can stay in Poland.

Getting a refusal after months of waiting is unpleasant. But it is not the end yet. The voivode's decision can be appealed, and quite often the case can be won — especially when there was a valid basis for the card and the refusal was due to missing documents or a formal mistake.

The most important thing in this situation is not to wait “until I calm down”. The clock is already ticking.

14 days — and not a day more

The appeal (odwołanie) is filed within 14 days of the day you received the decision. This deadline is not extended “by agreement”.

If the deadline was missed for a valid reason, you can ask for it to be reinstated. But this is a separate procedure, and the chances are noticeably lower. It is better to make it on time.

Where to file

The odwołanie is addressed to the Szef Urzędu do Spraw Cudzoziemców (Head of the Office for Foreigners), but it is filed through the voivode who issued the decision. There is no state fee for an appeal in a residence card case.

What to write so that it works

  1. Which decision you are appealing — its date and case number.
  2. Why it is wrong — point by point, responding to each reason for refusal given in the justification.
  3. New evidence — the documents that were missing, explanations, proof of income or accommodation.
  4. Your request — to overturn the decision and grant the permit, or to send the case back for reconsideration.

Tip: the strongest appeal is not emotional but specific. “The office believed I had no income — here are the certificates for the whole period” works better than “the decision is unfair”.

Can I stay in Poland

Yes, if you submitted your card application on time, during legal stay. Your stay remains legal until the decision becomes final — that is, also while the appeal is being considered.

Be careful with travel: the stamp or confirmation from the office does not give you the right to enter from outside the Schengen area. If you leave, you may not be able to come back without a visa.

How we help

We analyze the decision and the reasons for refusal, check the documents and the circumstances of the case, prepare a well-reasoned appeal and support the filing. The price is 700 zł. Don't put it off: every day leaves less time for preparation.
