Buying a plot in Poland? First check the MSWiA permit

A foreigner can buy an apartment freely, but a plot usually only with a permit. Without it, the purchase is invalid even after the notary.

You found the perfect plot, agreed with the seller, booked a notary — and suddenly it turns out you can't buy it yet. This happens if you don't know one rule: foreigners from outside the European Economic Area often need a permit from the Minister of the Interior (zezwolenie MSWiA) to buy land in Poland.

Without a permit, the purchase agreement is invalid — even if it has already been signed at the notary. Money, time, nerves — everything can go wrong.

When a permit is NOT needed

  • buying a separate apartment (samodzielny lokal mieszkalny) in an apartment building;
  • a garage or a share in a garage for your housing needs;
  • you have lived in Poland for at least 5 years after obtaining permanent residence or EU long-term resident status;
  • you are married to a Polish citizen, have lived here for at least 2 years after obtaining permanent residence or EU long-term resident status, and the property will be the spouses' joint property.

The exceptions do not apply to property in the border zone.

When a permit is needed

Most often — to buy a building plot, a house with land or agricultural land. MSWiA issues the permit by decision, and this can take several months.

Tip: apply for the permit before signing the preliminary agreement, and state in the agreement itself that the deal depends on obtaining the permit. That way you won't lose your deposit if something goes wrong.

What you need for the application

Documents showing your connection to Poland (residence card, work or business, family), information about the plot and how you plan to use it, and an extract from the księga wieczysta (land and mortgage register). The key is to show that your connection to Poland is real and stable.

How we help

We check whether you need a permit, prepare the application to MSWiA and support you until the decision. We work with legalization procedures every day, so we know how to submit the documents without unnecessary questions. The price is 3000 zł. And DomX will help check the plot itself: zoning, road access, utilities and the księga wieczysta.
